Terms of service

These terms govern your use of Tally. By creating an account or using the service you agree to them, so please read them.

1. Who we are

Tally is a web based takeoff and estimating service (the "service") available at hitally.ai. In these terms, "Tally", "we", "us", and "our" refer to the operator of the service, and "you" refers to the person or business using it.

2. The service

Tally lets you upload building plans and models through your browser, measure and count from them, apply your own rates, and export quantities and quotes. Uploaded 3D models are processed using Autodesk Platform Services to produce viewable geometry and extract element data. Your account data and takeoff data are stored in a managed database with a reputable cloud infrastructure provider.

3. Your account

You can sign in with Google or with an email address and password. You are responsible for keeping your sign in details secure and for everything done under your account. You must give us accurate account information and be at least 18 years old, or the age of majority where you live, to use the service.

4. Free trial and paid plans

New accounts start with a 7 day free trial with full access and no credit card. When the trial ends, your account becomes read limited: you can still sign in, view your projects, and export your work, but you cannot keep measuring and editing. Your data is not deleted when the trial ends, so you can pick up where you left off.

To keep using Tally after your trial, contact us at hello@hitally.ai and we will set up a paid plan with you. We tell you the price before you pay anything, and we never charge you without your agreement.

5. Your content

The plans, models, measurements, rates, and quotes you put into Tally are yours. You keep all rights to them. You grant us a licence to host, process, and display that content only as needed to provide the service to you, including processing models through Autodesk Platform Services. You are responsible for making sure you have the right to upload the files you upload.

6. Acceptable use

Do not use the service to break the law, infringe anyone's rights, distribute malware, or probe or disrupt the service or its infrastructure. Do not resell or provide the service to third parties as your own offering, and do not attempt to access another user's data. We may suspend or terminate accounts that breach these terms.

7. Quantities are your responsibility

Tally is a measurement and estimating aid. The quantities and prices it produces depend on your source files, your scale calibration, your measurements, and your configuration. You are responsible for checking any output before relying on it in a tender, quote, order, or contract. We do not warrant that any takeoff or estimate is complete or accurate for your purposes.

8. Availability and changes

We work to keep the service available and fast, but we do not promise uninterrupted or error free operation. We may change, add, or remove features, and we may carry out maintenance that temporarily affects availability. If we make a change that materially reduces the service you pay for, you can end your paid plan.

9. Intellectual property

The service, including its software, design, and branding, belongs to us or our licensors. These terms do not give you any rights in the service other than the right to use it while your account is in good standing.

10. Liability

To the maximum extent permitted by law, we are not liable for indirect or consequential loss, loss of profit, or loss of business arising from your use of the service, and our total liability to you in any 12 month period is limited to the amount you paid us for the service in that period. Nothing in these terms limits rights you have under the Consumer Guarantees Act 1993 or other New Zealand law that cannot be excluded. If you use the service for business purposes, you agree that the Consumer Guarantees Act 1993 does not apply to that use.

11. Termination

You can stop using the service at any time, and you can end a paid plan by letting us know at hello@hitally.ai. We may suspend or terminate your account if you materially breach these terms and do not fix the breach after we ask you to. On termination you can request an export of your data within a reasonable period, after which we may delete it as described in our privacy policy.

12. Governing law

These terms are governed by the laws of New Zealand, and the courts of New Zealand have exclusive jurisdiction over any dispute about them or the service.

13. Changes to these terms

We may update these terms from time to time. If we make a material change we will let you know, for example by email or a notice in the app, before it takes effect. The "Last updated" date at the top of this page shows the current version.
